Sokoto Appeal Court : dismisses appeals against House Leader,  5 other APC Lawmakers

The Court of Appeal,  Sokoto Division, on Thursday dismissed the Appeals filed against the elections of the House Leader, Sokoto State House of Assembly, Hon. Bello Isa Ambarura and five other Lawamkers of the All Progressives Congress  ( APC).

The Candidate of the Peoples Democratic Party  ( PDP), in the 23rd  February, 2019, elections into the Illela Constituency in the State House of Assembly,  Hon. Dayyabu Adamu Kalmalo, had filed an Appeal at the Court ,  challenging the dismissal of his petition against the election of Ambarura by the Tribunal .

In a majority Jugdment delivered by Justice Fatima Akinbanmi,  the Court affirmed the decision of the lower Court and consequently dismissed the Appeal, for lacking In merit

In a similar Judgment delivered by Justice Akinbanmi, the Court dismissed the Appeal filed by Hon. Nasiru Balarabe Assara of the PDP, against the election of Hon. Abdullahi Garba Sidi, representing Gwadabawa South Constituency.

The Court also awarded N 20,000 costs in favour of each of the three Respondents .

Also, the Court has dismissed an appeal by PDP’s  Habibu Mu’azu Gidan Kaya, as against the election of Hon. Muhammadu Bello Idris, representing Gwababawa North Constituency

Justice Akinbanmi said that , the Court also awarded N 50,000 costs in favour of each of the three Respondents.

In the same vein, in another unanimous Judgment delivered by Justice Hamma Barka Akawu, the Court dismissed the Appeal filed by Hon.  Mohammed Tukur of the PDP, against the affirmation of the election of  Hon. Aminu Magaji Bodai of the APC , representing Dange / Shuni Constituency by the Tribunal.

Justice Hamma stated that, the Court affirmed the decision of the Tribunal that, the earlier petition was statute barred .

Also, in another unanimous Judgment , Presiding Judge, Justice Ibrahim Musa Saulawa,  disclosed that, the Court has dismissed the Appeal filed by Hon. Abdulwahab Yahaya of the PDP, against the election of Hon. Faruku Ahmad of the APC , representing Goronyo Constituency.

He said that, the Court also awarded N 100,000 costs in favour of the 1st and 2nd Respondents.

In another judgment delivered by Justice Hamma,  the Court dismissed the appeal filed by Hon. Aminu Garba Gidado of the APC, against the election of Hon. Mohammed Malami Ahmed of the PDP, representing Sokoto South, One, Constituency.

Similarly,  Justice Hamma who delivered another unanimous Judgment averred that, the Court has dismissed an Appeal filed Hon. Malami Mohammed of the APC,  against the election of Hon. Halliru Buhari of the PDP, representing Sokoto North,  One, Constituency .

The appeal filed by Bashir Ahmed Dahiru of the APC, against the election of Hon. Romo Sule Hantsi of the PDP,  representing Tambuwal West Constituency was also dismissed by the Court as delivered by Justice Hamma.

In a unanimous ruling delivered by the Presiding Justice,  Justice Ibrahim Musa Saulawa,  the Court dismissed the Application filed by  Chief Adeniyi Akintola , SAN, praying it to set aside its October 30th , 2019, Judgment that affirmed the elections of Senator Ibrahim Abdullahi Danbaba of the PDP,  Sokoto South Senatorial District,  as well as Dr Balarabe Shehu Kakale of the PDP,  Dange / Shuni, Tureta and Bodinga, Federal Constituency.

Justice Saulawa averred that , the Court dismissed the Application and granted the Preliminary Objection filed by Chief Samuel Zibiri, SAN, praying the Court to dismiss the Application filed by Chief Adeniyi Akintola on behalf of Senator Abubakar Shehu Tambuwal and Hon . Aliyu Shehu .

He explained that , the Court has awarded N 50,000 costs against the Applicants .
